1. Introduction
1.1. These General Terms and Conditions (hereinafter: GTC) govern the use of the CityCode online platform (hereinafter: Platform, available at: https://www.citycode.hu), as well as the terms and conditions for utilizing the digital urban missions (hereinafter: Mission, collectively: Service) available for purchase through the Platform. 1.2. The Service Provider is a VAT-exempt small taxpayer (KATA). Accordingly, the Service Provider exclusively provides services to natural persons (private individuals) and does not sell to companies or other legal entities (entities with a tax number). Prices are established without adding VAT; no VAT is charged to the buyer. 1.3. By using the Platform, registering, or making a purchase, the User / Buyer accepts this GTC. During the purchase process, the GTC and the Privacy Policy must be accepted via a separate, explicit consent. 1.4. This GTC was originally drafted in Hungarian. The Service is primarily available to consumers in Hungary.
2. Definitions
User: a natural person visiting the Platform or creating an account.
Buyer / Player: a User tied to an account who purchases a Mission.
Mission: pre-planned, smartphone-based interactive urban adventure game content containing outdoor and/or location-specific elements.
Purchase / Access: a limited-time gaming right assigned to the Buyer's account after purchasing a Mission via the Platform.
Gift Card: a code with a pre-loaded value that can be redeemed on the Platform.
Coupon: a discount code that can be entered during the checkout process.
Team / Companion / Spectator: additional person(s) invited by the Buyer to play the Mission; certain functions (e.g., spectator mode) are accessible via a separate link.
3. Nature of the Service
3.1. CityCode qualifies as digital content and a distance service: the purchase grants access to the in-game content of the Mission and the functions of the Platform. 3.2. The Mission is an outdoor, pedestrian (and occasionally playable in a cycling environment) experience. Solutions can be provided based on information found outdoors at real-world locations, unless the description of the specific Mission states otherwise. 3.3. The game requires the use of a smartphone, an active internet connection, an adequately charged battery, and for certain functions, location services, a compass, a camera, or a motion sensor. The specific technical and location requirements are listed on the Mission's data sheet. 3.4. The Service Provider may modify the content, route, difficulty, duration, and other parameters of the Missions without prior notice if it serves to improve the gaming experience, except if the modification would significantly impair an already started, active gameplay. 3.5. The Platform is not a time-slot booked service: after purchase, the Buyer may start the Mission according to their own schedule within the access period, and may take breaks during the game. 3.6. Missions are tied to a location: they can only be completed within the territory of Hungary, in the settlement and along the route indicated on the data sheet of the given Mission. A Mission cannot be played through at any other location, and the Service Provider does not make completion possible from outside the indicated location. Before purchasing, the Buyer is obliged to make sure that the location of the Mission is accessible to them; the inaccessibility of the location does not constitute defective performance by the Service Provider.
4. Registration, Account, and Purchase Conditions
4.1. Purchasing a Mission requires a registered user account and a valid e-mail address. The purchase is linked to the account. 4.2. The User is obliged to provide real data and manage their account securely. To the extent permitted by law, the account owner is responsible for all activities conducted through their account. 4.3. During the purchase, the Buyer is obliged to accept the GTC and the Privacy Policy. 4.4. The Service Provider reserves the right to refuse, suspend, or revoke certain purchases, promotions, or accounts in the event of suspected abuse, fraud, or violation of Platform rules.
5. Orders, Prices, and Payment
5.1. The prices indicated on the Platform are in Hungarian Forint (HUF) and are final prices. The Service Provider is a VAT-exempt entity; therefore, prices do not include VAT, and no VAT is charged. 5.2. Payment is made online during the checkout process. Online bank card and other payment methods are executed via the Barion system. Bank card and other payment data do not reach the merchant. The service provider, Barion Payment Zrt., is an institution under the supervision of the Central Bank of Hungary (Magyar Nemzeti Bank), license number: H-EN-I-1064/2013. 5.3. The order is established upon the confirmation of successful payment. The Service Provider sends an electronic confirmation (via e-mail) regarding the purchase and the method of accessing the game. 5.4. In the case of purchasing multiple Missions together, the Platform may apply a discount (e.g., a 10% bundle discount) if the required minimum number of Missions is in the cart. 5.5. Coupon and gift card codes can be entered during checkout. The terms of the codes (validity, discount rate, usability) are set out in the description of the code or in the rules displayed on the Platform. The Service Provider is not obliged to accept any code that is expired, already used, or does not meet the conditions. 5.6. If the final amount is 0 HUF due to the technical minimum of the payment provider, the purchase may be completed on the Platform for free (e.g., in the case of a 100% coupon), based on the Service Provider's confirmation. 5.7. The Service Provider falls under the scope of the KATA tax law and is therefore only able to serve private individuals (natural persons). By executing the purchase and accepting the GTC, the Buyer declares that they are using the Service as a private individual (not as a taxable entity). The Service Provider does not issue invoices to companies, sole proprietors, or other organizations with a tax number. Should the Buyer nevertheless provide corporate details, the Service Provider is entitled to cancel the order and refund the purchase price. The Service Provider issues an electronic invoice for successful purchases in accordance with current legislation. 5.8. The Service Provider issues an electronic document for every successful purchase made for consideration, and sends it to the e-mail address given by the Buyer. The document is valid without a signature or stamp. 5.9. BY DEFAULT A RECEIPT IS ISSUED. Under Section 165(1)(b) of Act CXXVII of 2007 on Value Added Tax, the Service Provider is exempt from the obligation to issue an invoice if the Buyer is a non-taxable natural person, pays the consideration by bank card by the time of performance, the consideration is below HUF 900,000, and the Buyer does not request an invoice. In such cases the Service Provider issues a receipt (Section 166), for which the Buyer's name and address are not required. 5.10. BEFORE starting the payment, the Buyer may REQUEST AN INVOICE at checkout with a single click. In that case they must provide their billing name and address (country, postal code, settlement, street and house number); these are compulsory content elements of an invoice, and without them the order cannot be started. The Buyer may save this data to their own account for later purchases and may delete it at any time. If the consideration reaches HUF 900,000, the Service Provider issues an invoice in every case. 5.11. The Service Provider is a VAT-exempt small taxpayer, therefore the invoice contains no VAT and bears the markings "alanyi adómentes (AAM)" and "Kisadózó". The Service Provider neither requests nor states a tax number, as it sells exclusively to private individuals (see 5.7). 5.12. Invoicing is carried out through the invoicing system of Billingo Technologies Zrt. The data of the issued invoice is forwarded to the NAV Online Invoice system in accordance with the statutory obligation; the name and address of a private individual buyer are not included in that data reporting. 5.13. If the total is HUF 0 (e.g. due to a 100% coupon), no invoice is issued in the absence of consideration; the Buyer still receives a confirmation of the purchase.
6. Fulfillment, Access, and Gaming Rights
6.1. The fulfillment of the Service occurs by providing digital access. The average time for order fulfillment (the "delivery" of the digital content) is immediate (0 minutes): the purchased Mission automatically becomes available in the Buyer's account under the "My Purchases" menu after successful payment. 6.2. Access period: the Buyer is entitled to start the Mission within 365 calendar days from the purchase. From the first launch, a further 365 calendar days are available to complete it, meaning that the deadline restarts at the first launch. This applies unless the data sheet of the specific Mission states a different deadline. 6.3. After the access period expires, restarting or continuing the Mission is not guaranteed, unless the Service Provider grants separate written permission. 6.4. A completed Mission remains available in the Buyer's account after the access period has elapsed: the fact of completion, the result, and the clues collected during the game can be reviewed. The Service Provider undertakes this for as long as the Platform is operated. Replaying a completed Mission is not possible. 6.5. A purchase is linked to one account. The Mission can also be played in a team; the Buyer may invite companions or spectators using features provided by the Platform (e.g., shareable link). Group members are responsible for each other's safety and for respecting their surroundings. 6.6. The Service Provider does not provide devices (phone, power bank, mobile data), tour guiding, weather protection, or location tickets/entry fees, unless explicitly stated otherwise in the description of the specific Mission.
7. Gift Cards
7.1. A gift card represents a pre-paid value that can be redeemed during checkout for the purchase of Mission(s) on the Platform. 7.2. Validity period: a gift card can be redeemed for 1 (one) YEAR FROM ITS PURCHASE. The Service Provider records the expiry date when the card is issued, and it can be viewed at any time in the Buyer's account under the "My Purchases" menu. Once the validity period has elapsed, any unused balance can no longer be used and is not refunded. 7.3. Redemption: the Buyer enters the card code at checkout, before starting the payment. Redemption requires a registered user account, as does every purchase. 7.4. One gift card may be redeemed per order. A gift card can be used together with a discount coupon; in that case the card's balance is deducted first, and the coupon is calculated on the remaining amount actually payable. 7.5. Partial use: if the balance exceeds the amount payable, the difference stays on the card and can be used for further purchases within the validity period. If the balance is less than the amount payable, the Buyer settles the difference using the usual payment method. 7.6. A gift card is a bearer value: whoever holds the code is entitled to redeem it, and the Service Provider does not verify the identity of the person redeeming it. The Buyer must therefore treat the code with the same care as cash. The Service Provider is not liable for damages arising from the loss, unauthorised acquisition or sharing of the code. On first redemption the card becomes linked to the redeeming account. 7.7. Gift cards cannot be exchanged for cash, do not earn interest, and—to the extent permitted by law—are non-refundable, except in the case of mandatory consumer protection provisions or with the separate approval of the Service Provider. In the case of withdrawal and refunds, Section 8 applies. 7.8. A gift card can only be used on the Platform, for purchasing Missions. It cannot be redeemed for any other product or service, or for the purchase of another gift card. 7.9. When purchasing a gift card, the recipient's e-mail address can be provided; the Service Provider may forward the card code electronically. If the Buyer does not name a recipient, the card's balance becomes usable in their own account straight away, without having to type the code. The Service Provider issues an invoice for a gift card at the time of ITS PURCHASE. Redeeming the gift card — buying a Mission from the card's balance — does not qualify as a further transaction performed for consideration, therefore no separate invoice is issued for it; the redeemed amount appears as a deduction on the invoice of the Mission.
8. Withdrawal, Refunds, and Complaints
8.1. Consumer Withdrawal (14 days)
8.1.1. If the Buyer qualifies as a consumer, under the laws governing distance contracts, they may withdraw from the contract without giving any reason within 14 days.
8.1.2. In the case of digital content, the consumer does not have the right of withdrawal if performance has begun immediately, and the consumer has given their express consent to begin performance before the expiration of the 14-day withdrawal period, and has acknowledged that by doing so, they lose their right of withdrawal. During the purchase, the Platform requests the Buyer to provide this consent (by making the Mission immediately accessible).
8.1.3. If the right of withdrawal exists and the Buyer exercises it validly, the Service Provider shall refund the total paid amount within 14 days using the same payment method as the original transaction, unless the parties agree otherwise.
8.2. Technical and Fulfillment Errors
8.2.1. If the Mission is unusable due to a fault in the Platform (e.g., incomplete content, inaccessible after payment), the Buyer must promptly notify the Service Provider at contact@citycode.hu, preferably attaching the purchase ID.
8.2.2. The Service Provider will investigate the report and, in the case of a valid error, may provide a fix, new access, a coupon discount, or a refund—depending on the nature of the error.
8.2.3. The following shall not be considered fulfillment errors:
a malfunction of the Buyer's device, internet connection, or operating system;
providing an incorrect e-mail address;
expiration of the Mission's access period due to the Buyer's delay;
an external circumstance that safely makes the game impossible (e.g., closed location, official restriction) if it is beyond the Service Provider's control;
an incorrect solution submitted by the Buyer, provided the Platform functions correctly.
8.3. Voluntary Credits 8.3.1. The Service Provider is not obliged to offer a free withdrawal or "money-back guarantee" beyond the statutory minimum, but may provide an individual, equitable solution in cases of dissatisfaction, force majeure, or unique errors. By accepting the GTC, the Buyer requests the immediate commencement of the performance of the Service, and acknowledges that once performance has begun they lose their right of withdrawal under Section 29(1) of Government Decree 45/2014 (II. 26.). The Service Provider records the time and version number of the GTC acceptance in connection with the purchase.
9. User / Player Obligations
9.1. The Player must:
observe traffic and safety rules;
not enter paid or private property, closed buildings, or any location where entry is not instructed by the Mission's description;
not climb monuments, buildings, or vehicles;
be mindful of pedestrian and bicycle traffic, as well as nature conservation rules;
preserve the locations and not litter;
ensure parental supervision for players under 18 years of age, even if the specific Mission is accessible without age restrictions.
9.2. On the Platform, it is strictly prohibited to:
abuse, hack, automate, or overload the system;
publicly share solutions or content (walkthroughs, spoilers) if doing so violates the experience of other players or the rights of the Service Provider;
make purchases using fake data or abuse coupons.
9.3. The Player acknowledges that the Mission requires physical activity; in the event of health risks, medical advice should be sought. The game is played at one's own risk.
10. Intellectual Property
10.1. The Platform, Missions, texts, images, sounds, puzzles, logos, and other contents are the intellectual property of the Service Provider or its partners, and are protected by copyright, trademark, and other legal protections. 10.2. The purchase grants a limited, non-exclusive, non-transferable, personal right of use to play the purchased Mission. Copying, distributing, modifying, reselling, or publicly displaying the content without the prior written permission of the Service Provider is prohibited.
11. Limitation of Liability
11.1. The Service Provider provides the Platform "as is" and strives for continuous availability, but does not guarantee uninterrupted operation. 11.2. The Service Provider is particularly not liable for:
errors arising from the Buyer's device, internet service provider, or third-party services (e.g., Barion, map services, weather apps);
personal injury or property damage suffered by the Buyer during the game, provided it stems from the player's negligence, rule violation, or force majeure events;
lost profits, lost time, or data loss, to the extent permitted by law.
11.3. The limitation of liability does not apply in cases of intentional or grossly negligent damage caused by the Service Provider, nor in cases of mandatory liability towards consumers. 11.4. If liability can be established, the Service Provider's liability—to the extent permitted by law—is limited to a maximum of the equivalent value of the relevant purchase.
12. Data Processing
12.1. The processing of personal data is governed by the Privacy Policy. 12.2. During the purchase, the date and version number of the accepted GTC and Privacy Policy may be recorded. 12.3. Analytical cookies are only used with the User's consent via the cookie banner. The base (Base) version of the Barion Pixel is an exception: it is required by the acceptance agreement, its sole purpose is fraud prevention for card payments, and as a tool strictly necessary for providing the service securely it operates regardless of consent. The Service Provider does not use the full (Full) version of the Pixel, which would also collect data for marketing purposes. Details in the Privacy Policy. 12.4. The Service Provider retains the issued invoice and the data appearing on it for 8 years, pursuant to Section 169 of Act C of 2000 on Accounting. A deletion request by the User does not extend to this processing, which is based on a statutory obligation. 12.5. In the case of a receipt, the Service Provider does not state the Buyer's name or address on the document; the electronic receipt contains only the e-mail address required for its delivery. If the Buyer requests an invoice, providing the billing name, country, postal code, settlement, and street address is mandatory, as these are compulsory content elements of an invoice under Section 169 of Act CXXVII of 2007 on Value Added Tax. The Service Provider stores this data attached to the given payment and transfers it to the invoicing provider (data processor) for the purpose of issuing the invoice, which keeps a partner record of the Buyer. The Privacy Policy lists the data processors engaged. 12.6. At checkout, the Buyer may request via a separate checkbox that the Service Provider save their billing data to their account and offer it pre-filled at the next purchase. This is a convenience feature based on the Buyer's consent: the checkbox is EMPTY by default, so saving only happens after it has been ticked explicitly. Saved data can be changed or deleted at any time at checkout and in the profile, and is not accessible to anyone other than the account owner. Withdrawing consent and deleting the data does not affect documents already issued or the retention obligation under Section 12.4.
13. Complaint Handling and Dispute Resolution
13.1. Complaints and claims: contact@citycode.hu. The Service Provider aims to investigate and respond to complaints within 30 days. 13.2. For the resolution of consumer disputes: Vas County Conciliation Board (Vas Vármegyei Békéltető Testület), 9700 Szombathely, Márton Áron utca 12., Hungary. Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr 13.3. The parties shall attempt to resolve disputes amicably; should this fail, the Hungarian courts shall have jurisdiction, alongside the jurisdiction based on the consumer's place of residence.
14. Force Majeure
14.1. In the event of force majeure (e.g., natural disasters, government measures, extreme weather conditions, situations of war, widespread service outages), the Service Provider may suspend fulfillment. This shall not constitute a breach of contract, but the Service Provider may—at its own discretion—offer an extension, coupon, or refund.
15. Modification of the GTC
15.1. The Service Provider has the right to modify this GTC. The Platform will provide prior notice of the modification (version number, effective date). 15.2. The modification applies to purchases made after publication. For contracts concluded previously, unless otherwise stipulated, the GTC in effect at the time of purchase shall govern. 15.3. The version number recorded during the checkout process (e.g., v1.2) proves which GTC was accepted by the Buyer.
16. Final Provisions
16.1. This GTC is governed by Hungarian law. 16.2. Should any provision of this GTC be deemed invalid, the remaining provisions shall remain in full force and effect. 16.3. The Service Provider's contact e-mail address: contact@citycode.hu, phone number: +36203322089.
